Powers and Duties of Officers and Employees

(Reference: Section 4 (1) (b) (ii) of RTI Act, 2005)

The Right to Information Act, 2005 of the Government of India has come into force on 15th June, 2005. As per Section 4(1)(b) of this Act, every department has to publish the information on the points specified therein. The powers of the officers and the employees are derived from the various Government rules, directions, executive orders, etc. issued from time to time by the respective departments. Accordingly, the information pertaining to the organisation, functions and duties of Town and Country Planning Department, Uttar Pradesh is given below: -

Housing and Development Board on matters pertaining to Housing and Urban Planning.
5. To prepare base maps for Master Plans/Zonal Development Plans and Lay-out Plans after charging the prescribed fee from the concerned agencies.
6. To prepare proposals for declaration/ amendment of Development Areas/ Special Development Areas/Regulated Areas.
7. To provide technical advice to Development Authorities, Urban Local Bodies for planning and improvement of Traffic & Transportation System.
8. To represent as member in the Board meetings of Controlling Authorities, Development Authorities, Housing & Development Board, Special Area Development Authorities, Industrial Area Development Authorities and controlling Authorities.
9. To participate as member in the meetings of High Power Committee and other technical committees constituted for Hi-tech townships and Integrated Townships.
10. To direct, guide, monitor and get the draft Master Plans/Zonal Development Plans prepared by the divisional offices and guidelines of the Government as per the provisions of relevant Acts for Development Areas, Regulated Areas and Special Development Areas.
11. To advise the Government /Housing Board/ Development Authority/ Special Areas Development Authority/Controlling Authority on Master Plans of Development Areas/Regulated Areas/ Special Development Areas
12. To provide technical opinion on the lay-out plans and building plans taken up by Local Bodies/Development Authorities/Housing Board/ Special Area Development Authority, Prescribed Authority referred to the department.
13. To appraise and provide technical advice on urban development projects referred by Government/Development Authorities
14. To provide administrative, financial and technical support to subordinate officers and employees for performance of their duties.
15. To Provide interpretation of Master Plan/Zonal Development Plans including Zonal regulations with regard to specific cases referred by Government /Development Authorities.
B ADMINISTRATIVE
16. Appointment on ground of being depended of Deceased Govt. Employee. (Non-gazetted staff)
17. Service matters of Non-Gazetted staff
18. Promotion of Non-Gazetted staff
19. Assist Government by taking part in Departmental Promotion committee for promotion of Gazetted officers
20. Transfer and posting of all non-Gazetted staff
21. Conduct disciplinary proceedings against Non-Gazetted staff and take actions, if any
22. Journey approval of all officers
23. Sanctioning of Earned/ Medical Leave up to 60 days of all officers
24. Sanctioning of Earned Leave up to 120 days and Medical Leave up to 365 days of all non-gazetted staff.
25. Sanctioning of retirement benefits of all officers and employees
26. Maintenance of office vehicles and machineries
C FINANCIAL
The Chief Town and Country Planner, Uttar Pradesh has been accorded the status of Head of Department and all the powers of Head of Department under the Fundamental and Subsidiary Rules (Financial Handbook, Volume II, Parts II to IV), the Traveling Allowance Rules (Financial Handbook, Volume III) and the Account Rules (Financial Handbook, Volume V, Part I) have been delegated to him. In exercising such powers he will bear all responsibilities for action taken and orders issued according to this delegation.
27. To seek budget allocation from the Government for the performance of department’s function and take/accept financial assistance  from Development Authorities/Controlling Authorities for the preparation of base map,Master/Zonal Development Plans.
28. Drawing and Disbursement Officer of Headquarters.
29. To sanction GPF advances/withdrawals of all officers and employees
30. To sanction House Building, Car/Motor-cycle/Scooter/Cycle and other advances to all officers and employees
31. Reimbursement of various claims of all officers and employees as per rules
32. Purchases related to department as per Government rules.
33. Purchase of Books, Magazines, Maps for the use of  Department.
POWERS
A TECHNICAL
1. Technical Approval of draft Master Plans/ Zonal Development Plans/Layout Plans/Housing Schemes at the department level before submitting to the Development Authority/Controlling Authority/Special Area Development Authority.
2. To issue 'NO OBJECTION' certificate for lay-out plans of more than 1.0 hectare area and for building Plans having covered area of more than 250 Sq.m. in all Regulated Areas of the State.
3. To issue No Objection on the lay-out plans/Building plans as member of the Technical Committee in all Development Authorities.
4. Interpretation of Master Plans/Zonal Development Plans including Zoning Regulations with regard to specific cases referred by Government/Development Authorities/Controlling Authorities
B ADMINISTRATIVE
5. Appointment on ground of being depended of Deceased Govt. Employee. (Non-gazetted staff)
6 Accord sanctions in various service matters of Non-Gazetted staff
7. Promotion of Non-Gazetted staff
8. Transfer of all non Gazetted staff
9. Disciplinary proceedings against Non-Gazetted staff
10. Recommend disciplinary action in case of all class-II and class-I Gazetted officers of the department after conducting enquiry as per the directions of Government
11. Journey approval of all officers and employees
12. Sanctioning of Earned/ Medical Leave up to 60 days of all officers and employees
13. Sanctioning of retirement benefits of all officers and employees
C FINANCIAL
14. To Allocate Budget to various offices of the department.
15. Drawing and Disbursement Officer of Headquarters.
16. To sanction GPF advances/withdrawals of all officers and employees upto 90%
17. To sanction House Building, Car/Motor-cycle/Scooter/Cycle and other advances to all officers and employees
18. To Reimburse various claims of all officers and employees as per rules
19. To perform purchasing related to department as per Government rules.
20. To sanction expenditure on maintenance of office vehicles and machineries as per Government rules
21. To sanction purchase of Books, Magazines, Maps for the use of Department
2. Chief Co-ordinator Planner,
N.C.R. Planning Cell, Ghaziabad
U.P. sub-region of National Capital Region DUTIES
1. To prepare draft sub-regional plan for U.P. sub-region under the National Capital Region within the framework of National Capital Region Plan under the provisions of N.C.R.P.B. Act,1985
2. To assist Commissioner and Chairman, N.C.R.P. Board
3. To assist/participate in the meetings of various committees constituted by N.C.R.P. Board
4. To participate as member of the Board of Development Authorities falling within U.P. sub-region of National Capital Region
5. To monitor and co-ordinate various projects/ schemes by different implementing agencies within U.P. sub-region of National Capital Region
6. To perform the function of Head of Office such as annual increment, Earned Leave/Medical Leave sanction up to 60 days of non-gazetted staff, journey approval of all officers and employees under his jurisdiction.
7. To perform purchasing related to his office as per Government rules.
8. To Maintain office vehicles and machineries.
9. To sanction GPF advance to all officers and employees under his jurisdiction up to 3 months basic salary or 50% of the balance available in the account, whichever is less
POWERS
1. To approve sub-regional plans for U.P. sub-region before submitting it to Chief Town and Country Planner, Uttar Pradesh
2. Drawing and Disbursement Officer of N.C.R. Planning Cell, Ghaziabad
3. To sanction annual increment, Earned Leave/Medical Leave up to 60 days of non-gazetted staff, journey approval of all officers and employees under his jurisdiction.
4. To sanction GPF advance to all officers and employees under his jurisdiction upto 3 months basic salary or 50% of the balance available in the account, whichever is less
5. Purchasing related to his office as per Government rules.
6. Sanctioning of expenditure for maintenance of office vehicles and machineries as per Government rules
3. Senior Planner Area/ Divisional offices assigned by CTCP DUTIES
1. To direct guide, monitor and get the draft Master Plans/Zonal Development Plans for Development Authorities, SADA and controlling Authorities prepared by the divisional offices and in accordance with the provisions of relevant Acts and as per the guidelines of Government.
2. To supervise other technical works assigned to divisional offices/officers
3. To assist and help CTCP in performing his duties enlisted above
4. Disposal of works assigned and directed by CTCP related to the department
4. Executive EngineerTechnical State of U.P. 1. Technical examination of the estimates of Urban Development Schemes and IDSMT Schemes and submit recommendation/comments to CTCP.
2. To provide assistance to CTCP in engineering matters related to urban planning of the department
3. To prepare progress report on the prescribed format for monthly review meetings of Planning Department
4. To prepare reports in respect of audit objections raised by Accountant General.
5. To assist CTCP in preparation of Draft Annual Plan/Five Year Plan of Housing and Urban Planning Department, preparation of reports relating to audit objections and preparation of draft Performance Budget of Housing and Urban Planning Department as per the directions of Housing and Urban Planning Department
6. All other works assigned by CTCP
5. Executive Engineer
Physical Survey Division (PSD)
All Regulated/ Development Areas  1. To conduct Physical surveys on the request of various Authorities/Agencies using various techniques and deliver survey maps to the concerned agencies

6. Town Planner/Senior Architect / Architect Planner 1. To assist and help Senior Planner/CTCP in performing his duties enlisted above
2. Disposal of works assigned and directed by Senior Planner/CTCP related to the department

9. Assistant Traffic and Transportation Planner 1. To assist CTCP/Senior Planner/Town Planner in all matters related to Traffic & Transportation Planning

10. Personal Assistant (Technical) 1. To assist CTCP in the administration and management of the headquarters affairs.
2. To assist CTCP in the disposal of matters referred by various government departments as well as the public.
3. To carry out all other works assigned by CTCP
11. Assistant Engineer 1. To assist Executive Engineer PSD and EET in all the matters assigned to them by CTCP
2. To assist Executive Engineer Technical in all the matters assigned to him by CTCP

12. Statistical Officer 1. Collection and analysis of statistical data and other information as per the requirements of the department
2. To assist and help Town Planner/Architect Planner/Senior Architect/Senior Planner/CTCP in procuring statistical data
13. Assistant Sociologist 1. Collection and analysis of socio-economic data and other information as per the requirement of the department
    2. To carry out the works assigned by the CTCP
14. Finance and  Accounts Officer 1. To assist and advise CTCP on matters related to Accounts.

  ii. To carry out assessment of the above mentioned proposals as per the norms and directions issued by the Chief Town and Country Planner/State Government.
  iii. To carry out preliminary investigations and to assist the local administration in preparation of amendment proposal of already declared such areas as mentioned at sl.no.’1’ above.
2. Preparation of Draft Master Plan/Zonal Development Plan
After declaration of Town and Country Planning Department as an agency for preparation of Master Plan/Zonal Development Plan ,the duties of Associate Planner are given as below:-
  a) To assist the concerned agency in preparing base map on the basis of physical survey or satellite imagery, and to conduct socio-economic, and traffic & transport surveys as necessary and to collect secondary data required for preparation of plans.
  b) To prepare existing land use maps and such other maps required for the purpose of preparing draft Master Plan/Zonal Development Plan.
  c) To evaluate the existing Master Plan/Zonal Development Plan, if any with regard to proposals, directions of growth and deviations, etc. as directed by Sr. Planner/C.T.C.P.
  d) To prepare draft Master Plan along with land use proposals and report in consultation with Senior Planner/Chief Town and Country Planner, Local Authorities and concerned Government Departments.
  e) To assist the concerned authority for inviting public objections & suggestions on the draft Master Plan/Zonal Development Plan.
  f) To prepare comments on objections and suggestions received from the public and to present the same to the committee constituted by the Government for the purpose of disposal of objections and suggestions.
  g) To finalize Master Plan/Zonal Development Plan in the light of decisions taken by the concerned authority on the objections and suggestions received and submit the same to the Competent Authority.
3. To examine the proposals received from headquarter with regard to land use change/ amendment in Master Plan and submit the comments to CTCP.
4. To incorporate amendments made by the State Govt. in the Master Plan/Zonal Development Plan.
5. To provide technical assistance to various implementing, Controlling and Prescribed Authorities.
6. To participate in the meetings of Controlling Authorities.
7. To examine and submit report to Senior Planner/CTCP on all the matters referred by Government/Department
8. To prepare urban development projects as directed by Chief Town and Country Planner
9. To issue No Objection Certificates on the building plans with covered area more than 1000 Sq.m. and on the layout plans below 1.0 hectare area referred to by the Prescribed Authorities.
10. To represent in the Board meetings of Development Authorities as nominee of Chief Town and Country Planner.
11. Head of Office Functions
  (i) To exercise administrative control over subordinate officers and staff.
  (ii) To function as Drawing and Disbursing Officer for all departmental offices in the Commissionary
  (iii) All other works assigned by Senior Planner/ CTCP
POWERS

2. To sanction annual increment, Earned Leave/Medical Leave up to 42 days of non-gazetted staff, tour approval of all officers and employees under his jurisdiction.
3. To sanction GPF advance to all officers and employees under his jurisdiction upto 3 months basic salary or 50% of the balance available in the account, whichever is less.
4. Purchasing related to his office as per Government rules.
5. Maintenance of office vehicles and machineries as per Government rules.
2. Assistant Planner/ Assistant Architect Planner/ Assistant Town Planner Assigned Commissionary DUTIES
1. To assist and help Associate Planner in performing his duties enlisted above
2. Disposal of works assigned and directed by the Associate Planner
3. To issue No Objection Certificates (as delegated power) on the building plans referred by the Prescribed Authorities.
4. To comply with the directions of Senior Planner/CTCP through Associate Planner
